The duties and powers of our Department are determined in Article 49 of the “Presidential Decree on the Presidential Organization no. 1”.

Accordingly, the duties and powers of our Department are as follows:

a) to pursue the applications filed with the European Court of Human Rights (the Court or the ECtHR) against the Republic of Turkey with the cooperation of the Ministry of Foreign Affairs, to request every type of information, document and opinion concerning applications from relevant institutions and organisations, to prepare observations and to send representatives to the sessions when necessary,

b) to employ the methods friendly settlement and unilateral declaration when necessary,

c) reserving the judgments under enforcement proceedings initiated by the Ministry of Foreign Affairs, to perform duties and procedures in the enforcement of the judgments of the Court finding violations against the Republic of Turkey, to submit the judgments to the relevant authorities, to pursue the process for the elimination of the violation and to take necessary measures.

d) reserving the judgments under enforcement proceedings initiated by the Ministry of Foreign Affairs, to pay the compensations ruled by the Court against the Republic of Turkey and the compensations and costs which have arisen from friendly settlements and unilateral declarations or which have been agreed upon by the parties pursuant to Article 41 of the European Convention on Human Rights (the Convention),

e) to pay the compensations decided by the commission established pursuant to the Law no. 6384 on the Resolution, By Means Of Compensation, Of Certain Applications Lodged With The European Court Of Human Rights dated 9 January 2013

f) to issue notifications to the relevant institutions and organizations for the assessment of recovery (rücu),

g) to submit Ministry opinion concerning individual applications sent to the Ministry by the Constitutional Court, if necessary,

h) to carry out activities to eliminate the violations of human rights within the scope of its jurisdiction,

i) to prepare projects concerning human rights in cooperation with the relevant institutions and organisations and to organize symposiums, seminars and training activities at international and national level,

j) to provide the translation of the judgments of the Court in respect of the Republic of Turkey and necessary judgments against other countries into Turkish and to organize and archive them,

k) to keep track of scientific studies regarding the Convention and its practice, to take action to provide the relevant authorities with relevant books, articles, reports, guides and case-law, to carry out statistical works,

l) to keep track of the international institutions and organisations’ activities on human rights with the cooperation of the Ministry of Foreign Affairs and to inform the relevant institutions and organisations in order to reflect the developments in the field into the domestic law ,

m) to perform the other duties assigned by the Minister.
